The preliminary contract, called ‘Compromesso’, represents the first stage of the conveyancing process in Italy. This is a contract which is usually prepared by your trusted estate agent and then signed by both the buyer and by the vendor/s. It ought to be said that the prelimary contract is a legally binding contract with heavy penalties to be paid by the party that breaches the agreement. At the signing of the Compromesso the Buyer will be asked to make a deposit, the amount of which is between 10% and 30% of the purchase price. The penalty in case of breach of agreement by the buyer is that he loses the deposit paid. If, on the other hand, it is the vendor that decides not to go ahead with the sale than the buyer is due twice the deposit back. So basically the percentage agreed as a deposit is the sum that the party that breaches the agreement would lose.
