The next step to choosing the property you wish to buy is the draft, approval and signing of a preliminary contract. The preliminary contract, called ‘Compromesso’, represents the first stage of the conveyancing process in Italy. This is a contract which is usually prepared by your trusted estate agent and then signed by both the buyer and by the vendor/s. It ought to be said that the prelimary contract is a legally binding contract with heavy penalties to be paid by the party that breaches the agreement. Just make sure that you put yourself in good and professional hands and that the contract is drafted by someone you trust and that it has been translated into your language.

The preliminary contract of ‘Compromesso‘.

With the signing of the Compromesso the vendor commits himself to selling his/her property and the buyer commits himself to buying that very same property. The compromesso will have to contain contain all the clauses agreed with the vendor. Essential elements are:  the intended date for completion, the agreed purchase price and the modality and date for payment the agreed price. At the signing of the Compromesso the Buyer will be asked to make a deposit, the amount of which is between 10% and 30% of the purchase price. The penalty in case of breach of agreement by the buyer is that he loses the deposit paid. If, on the other hand, it is the vendor that decides not to go ahead with the sale than the buyer is due twice the deposit back. So basically the percentage agreed as a deposit is the sum that the party that breaches the agreement would lose.

The final Deed of Sale

The second stage of the conveyancing in Italy is the Final Deed of Sale, or Rogito, which is prepared by a notary and signed by all parties in his office. The ‘rogito’ must also be translated into your language for it to be valid. The notary is responsible for carrying out all necessary searches to ensure that no mortgage, bad debt of other impediment can affect the sale of the property. The signing of the Deed coincides with the completion date. The notary is responsible for paying all the due taxes on behalf of the Buyer as well as for registering the contract at the Property Registry office. Before the signing of the rogito we will advise you about all the purchase expenses including the various taxes, the notary fees and all the other payable professionals fees.
